In New York, the number of points assigned to your driving record depends upon the violation for which you have been convicted.  Here are some of the common infractions that may result in points being added to your driving record.

3-Point Violations

  • Speeding (1-10 mph over the speed limit (3 point infraction). $143-$243
  • Failure to recognize a stop sign or traffic signal: 3 points.
  • Failure to obey child safety restraint regulations: 3 points.
  • Fleeing the scene of an accident when resulting in property damage or the injury of an animal: 3 points.
  • Violating a no passing zone (3 point infraction).
  • Illegal lane change (3 point infraction).
  • Driving left of center line, driving in wrong direction (3 point infraction).
  • Railroad crossing violations (3 point infraction).
  • Leaving the scene of a motor vehicle, bicycle or pedestrian accident (3 point infraction).
  • Seat belt infractions for passengers under 16 years (3 point infraction).

4-Point Violations

  • Failure to keep a safe following distance: 4 points.
  • Speeding 11 to 20 mph over the speed limit: 4 points. $183-$393 fine
  • Speeding more than 11 mph over limit (4 point infraction).
  • Tailgating, Following Too Closely (4 point infraction).
  • Failure to brake properly (4 point infraction).
  • Inadequate brakes (private car)

5-Point Violations

  • Texting while driving: 5 points.
  • Reckless Driving/operation of a vehicle: 5 points, $193-$393 fine
  • Passing a school bus when stopped: 5 points.
  • Speeding more than 20 mph over limit (5 points or more each infraction).
  • Failing to stop for a school bus with stop sign extended (5 points or more each infraction).
  • Use of portable electronic device (includes, but not limited to texting, Talking on a handheld mobile telephone, Composing, sending, reading, accessing, browsing, transmitting, saving, or retrieving electronic data such as e-mail, text messages, or webpages, Viewing, taking, or transmitting images and Playing games).  (5 points or more each infraction).
  • Improper cell phone use
  • Any other moving violation

6-Point Violation

  • Speeding 21 to 30 MPH over the speed limit: 6 points, $183-$393

Over 8 Points

  • Speeding (31-40 mph over): 8 points. $273-$693
  • Speeding more than 40 mph over limit: 11 points $273-$693
  • Reckless driving more than 40 mph over limit (11 pts.)

Points are not assigned for the following violations

  • any bicycle violation
  • any pedestrian violation
  • any parking violation
  • any violation related to unregistered, unlicensed or uninsured operation
  • any violation related to motor vehicle inspection, vehicle weights or dimensions or vehicle equipment other than inadequate service brakes
  • any violation related to a business or the sale of goods established in the Vehicle and Traffic Law or any local law
  • a violation related to the improper use of High Occupancy Vehicle Lanes in Suffolk County, between exits 49 and 57 of the Long Island Expressway
  • any other violation not resulting from the operation of a motor vehicle
